Fiscal receipt vs. invoice – what are the differences and when is it possible to exchange one for the other?

The difference between a fiscal receipt and an invoice comes down to whom the seller issues the document to. A fiscal receipt issued by a cash register confirms a sale to a consumer, i.e. a natural person who does not conduct business activity, whereas an invoice documents a sale to a business. A receipt can be converted into an invoice containing the buyer’s tax identification number (NIP) only if the buyer’s NIP was included on the receipt. A receipt bearing the buyer’s NIP for an amount of up to PLN 450 gross is itself a simplified invoice.

Key Information from the Article

  • A fiscal receipt documents sales to natural persons who do not conduct business activity, whereas an invoice is mandatory for sales to another business.

  • A receipt bearing the buyer’s NIP for an amount of up to PLN 450 gross or EUR 100 qualifies as a simplified invoice, and the seller must not issue an additional invoice for the same transaction.

  • Since 1 January 2020, an invoice containing the buyer’s NIP can be issued against a receipt only if the buyer’s NIP was included on the receipt.

  • A consumer may request a personal invoice within three months from the end of the month in which the goods were delivered or the service was performed.

  • Issuing an invoice containing a NIP against a receipt without a NIP may result in a penalty equal to 100% of the VAT amount shown on that invoice.

Fiscal Receipt vs. Invoice – What Does Each Document Record?

A fiscal receipt confirms a sale to a consumer that has been registered using a fiscal cash register, whereas an invoice documents a sale to another taxable person and includes their details, including their NIP. The seller issues a receipt without the buyer having to request one, at the time payment is received. It contains the receipt number and date, the seller’s details, the name and quantity of the goods, and the amount payable. An invoice may be issued in paper or electronic form. It is included in the buyer’s accounting records as an accounting document and specifies the applicable VAT rates and amounts.

Invoice or Receipt – Which Document Should Be Issued?

The choice between an invoice and a receipt depends on the buyer’s status. A sale to a business requires an invoice, while a sale to a consumer is registered using a fiscal cash register and confirmed by a receipt. A consumer can receive an invoice upon request. The obligation to issue an invoice also arises when an advance payment is received from another business and in the case of intra-Community distance sales of goods (WSTO), unless the seller uses the VAT One Stop Shop (OSS) scheme. The seller must establish the buyer’s status and obtain their NIP before finalising the sale at the fiscal cash register.

A Receipt Instead of an Invoice – When Is It Sufficient for a Business?

A receipt is sufficient for a business instead of a standard invoice if it contains the buyer’s NIP and the total amount does not exceed PLN 450 gross or EUR 100. Such a document qualifies as a simplified invoice. Four conditions must be met:

  • The buyer’s NIP must appear on the receipt.

  • The total amount payable must not exceed PLN 450 gross or EUR 100.

  • The information provided must make it possible to calculate the VAT amount.

  • The printout must include information about any discounts granted.

A simplified invoice entitles the buyer to deduct input VAT and include the expense in their business costs. According to the explanations issued by the Polish Ministry of Finance, the seller must refuse to issue a standard invoice in this situation because a single sale cannot be documented by two invoices. Issuing a second invoice could expose the seller to double taxation of the transaction.

Can an Invoice Be Issued Based on a Receipt?

An invoice containing the buyer’s NIP can be issued based on a receipt only if the buyer’s NIP was included on it at the time of sale. This rule follows from Article 106b(5) of the Polish VAT Act and has been in force since 1 January 2020. Without the identification number, it is not possible to verify whether both documents were issued to the same buyer. Therefore, converting a receipt into an invoice depends on the presence of the NIP, the buyer’s status, and the total amount payable.

SituationCan the seller issue an invoice? What to bear in mind
Receipt with NIP for up to PLN 450 gross (EUR 100)No – the receipt is already a simplified invoice. The seller must refuse to issue a standard invoice.
Receipt with NIP for more than PLN 450 grossYes – an invoice can be issued against the receipt. The NIP must be provided before the receipt is printed.
Receipt without NIP, purchase made for a businessOnly a personal invoice; an invoice containing a NIP is not permitted. The penalty amounts to 100% of the VAT shown on the invoice.
Receipt without NIP, buyer is a consumerYes – a personal invoice without a NIP.The request must be made within three months.

Issuing Invoices Against Receipts – What Deadlines and Rules Apply?

The buyer may request an invoice against a receipt within three months from the end of the month in which the sale took place. The seller must issue the invoice by the 15th day of the following month if the request was submitted in the month of sale, or within 15 days of a request submitted later. The three-month deadline is set out in Article 106b(3) of the Polish VAT Act. It runs from the end of the month in which the goods were delivered, the service was performed, or payment was received.

The seller first registers the sale using a fiscal cash register and prints the receipt, and only then issues the invoice. Once an invoice has been issued, the receipt for that transaction cannot subsequently be fiscalised. The original receipt is attached to the copy of the invoice. When both an invoice and a receipt exist for the same sale, the invoice is included in the records section of the JPK file with the FP designation, including when it was issued to a consumer. Such an invoice serves an accounting-record purpose, while the revenue is determined based on the receipt, so double taxation does not occur.

A Receipt Issued by Mistake Instead of an Invoice – What Can Be Done?

If a business receives a receipt instead of an invoice, the next steps depend on whether the buyer’s NIP appears on the receipt. If it does, an invoice may still be obtained; if it does not, the seller can issue only a personal invoice. If the NIP appears on the receipt and the amount does not exceed PLN 450 gross, the buyer already has a simplified invoice. For amounts exceeding this threshold, the buyer should ask the seller to issue an invoice against the receipt.

A personal invoice identifies the buyer as a private individual. Issuing an invoice containing a NIP against a receipt without a NIP may result in a penalty equal to 100% of the VAT amount shown on the invoice. The seller may also end up accounting for VAT twice: once based on the fiscal cash register report and again based on the invoice. This mistake can be prevented by providing the NIP before the seller prints the receipt.
